Thank you for contacting my office regarding vaccination requirements. I appreciate hearing from you.
As you may know, on September 9, 2021, the Biden Administration announced a series of rulemakings and executive actions to effectively require vaccination against COVID-19 for all federal agency employees (including contractors), employers with 100 or more employees, and staff in most health care settings serving Medicare and Medicaid patients. On November 5, 2021, the Occupational Safety and Health Administration (OSHA) and the Centers for Medicare and Medicaid Services (CMS) published interim final rules regarding the September-announced requirements.
I believe receiving the vaccine is the right choice for most of America given its effectiveness in reducing the risk of infection, hospitalization, and death due to COVID-19. My family and I received the vaccine, and I encourage everyone medically able to make that same decision. That being said, while I believe private businesses and state and local governments should be able to establish vaccination requirements at their discretion, I do not believe it is the appropriate role of the federal government to impose universal vaccination requirements. Indeed, the outlined requirements and a fine of $13,650 per violation included in OSHA’s interim final rule will further alienate the skeptical and could easily force an employer that has taken considerable steps to encourage vaccination among its staff to be penalized, cut employees, or even close its doors. I will be joining many of my Republican colleagues in an attempt to revoke this mandate via the Congressional Review Act in hopes of stopping it before it causes unnecessary harm.
Please be assured that my staff and I continue to monitor the development of vaccination policies within the Commonwealth and across the federal government. I greatly value your perspective on this issue and will be sure to keep your thoughts in mind should this question be further litigated in the court system or legislation relating to vaccination requirements come before the Senate.
