federal judge Friday denied a Native American tribe's request for a temporary restraining order to halt construction on the controversial Dakota Access Pipeline. U.S. District Judge James E. Boasberg wrote in his decision that the Standing Rock Sioux Tribe failed to show "it will suffer injury that would be prevented by any injunction the Court could issue."

Obama orders ND pipeline construction to stop

The Obama administration said it would not authorize construction on a critical stretch of the Dakota Access pipeline, handing a significant victory to the Indian tribe fighting the project the same day the group lost a court battle.

The administration said construction would halt until it can do more environmental assessments.

The U.S. government moved on Friday to halt a controversial oil pipeline project in North Dakota that has angered Native Americans, blocking construction on federal land and asking the company behind the project to suspend work nearby.

A court is not empowered by stop construction because it "angers" certain people, Tibs. Injunctive relief is appropriate only where the party shows that it will suffer irreparable harm.

In this instance, the protesters and litigants argued that the construction threatened to bulldoze an ancient burial ground, or other culturally relevant sites, or that the pipeline risked contamination of water supplies.

The judge who denied the injunction found that the pipeline builders had complied with the NHPA (National Historic Preservation Act) and that the Tribe "has not shown it will suffer injury that would be prevented by any injunction." Basically, the claim that the land was an ancient burial ground was just not supported by the evidence, as was the claim of potential water contamination.

One very irritating thing about the Obama administration is its cavalier attitude towards judicial rulings that it does not like. This is just the latest example, since the Obama administration stopped the construction immediately after the court - based on the evidence presented - found no basis for the injunction.
 
Pipelines are by far and away the cheapest AND safest way to transport fossil fuels. It's not even close.

I don't really understand the argument against them. All that fossil fuel is just going to end up on rails and highways and be in much closer proximity to people and population centers.

Oh well.... another "narrative" of liberal America that is not based on fact. Like they think stopping a pipeline will somehow stop fossil fuel excavation.....
 
While I can't speak for them, and I'm certainly a drill baby drill kinda guy. This strikes me because we're like **** you NA we can do what ever. If you parents, and grandparents and on and on where in same ground somewhere you going to be upset with the new condo going up. I would.

The pipeline company apparently never saw the movie "Bubba Ho-Tep" about disturbing dead Indians. They'll kill you and suck your soul out through your *******.

We need to protect these Indians from oil! No more evil heating oil, diesel, or gasoline on the rez! Let’s help them show the way to better future without fossil fuels!

Horseback and wood stoves for all of them - back to the sacred land!

All Indian land is sacred and must remain untouched.

I have sort of been following this. I have wondered what the real reason for the protest has been I kind of suspect that somebody didn't pay enough bribes to the tribal elders.

It is not a bribe. It is a sacred offering to the spirits of animal ancestors.

Yep, And then there's all the Liberals that say "Amen" to decisions like these forgetting that these efforts simply leave us beholden to the middle east for our oil. There are so many positives to being in debt to those countries for our main, primary and necessary energy source...

Oh, yeah, but...green energy is coming.

Did they ever do environmental impact statements? That would show if there are any burial sites evolved.
