Nursing Homes No Longer Required to Staff an RN?

I saw this article, but did not dig deep into it yet. It basically says trump and rfk.jr are removing the federal mandate to have RN staffing at nursing homes. I thought staffing was more of a state regulation vs federal. In PA staffing went from a 2.7 ppd up to 3.2 not to long ago. We got tagged by the state for not meeting ratios, and we also got tagged because we were 15 mins short of not having 24hr RN coverage for a day. As far as I can remember we did not get federal tags for anything related to staffing ratio.
 
Cms sets the standards that must be met. States are ones that enact regs that must meet and or exceed the feds.

So if true, it allows states to no longer be handcuffed by having an RN around the clock. They may choose to keep it, but no longer mandated too.

Right but almost all tags we get are federal tags. Normally if you don't clear a tag you won't get recertified or possibly have to go on a provisional license. The staffing tags were classified as a state tag and didn't effect recertification. We had open staffing tags for months. If we were under ppd or ratio even one day DOH would say we are still out of compliance, but it did not effect reimbursement or recertification.
 
Because pa has a higher requirement than cms hence your tag being a state level tag.
 
Ever since Covid nursing homes have been having trouble finding enough staff.
 
H1-B visa can fix that. The person won't be qualified. Maybe they lied or falsified information on their resume. My ENT doctor is an H1-B hire. He doesn't know anything. He told me there is nothing wrong...my eyes are red and water incessantly. My throat is irritated, red and sore all the time. My eustachion tube is clogged. Pressure behind the eye. Nothing wrong. Give that man a cigar.
