Brady wins

As far as I can tell, teams should be writing to the league asking why current suspensions should"stand" as the commissioner doesn't have the authority to fine or suspend players.

I see no reason Bell and Bryant shouldn't suit up. It's not like Goodell can fine or suspend them. Seriously. I'm not even kidding. The NFLPA lawyers should be all over that. Goodell doesn't have the authority to mandate player behavior on or off the field. If Roger wants to fight it, He can have the NFL file suit against the NFLPA who will represent the players in a class action suit. Clearly he has overstepped his bounds in assigning fines and suspensions and he doesn't have clear guidelines or boundaries. Thus, all suspensions and fines given under Goodell are clearly invalid and frankly out to be refunded monetarily to the players who paid them. Probably with interest.
I did not read the entire decision, obviously. From what I did read it didn't say that he didn't have the right to fine or suspend players. And the NFLPA recognized that in their response. It said he didn't act judiciously in this case and that Brady's inability to question Pash was unfair. It made no point about whether Brady was guilty or not guilty. It jsut said the process of comparing deflation of balls to Steriod use was unfair and the Pash thing among others I'd assume.

Sask, regardless of the legal speak the judge and the NFLPA attempts to put around it, the end result of the ruling is that the Commissioner is found to be unable to fine or suspend players. That the judge was too much of a ***** to actually come out and word it appropriately doesn't change the fact that there is a now a Titanic sized gash in the side of the boat.

Water is flooding into the CBA and one of the cornerstones for the owner's side of the Agreement is now determined "invalid". Now all contracts have a clause that says "if one aspect of this contract is found to be invalid that doesn't mean that all other clauses are invalid" but it pretty much means that all other aspects are now open to investigation because you've now determined that one of your components of the contract is bullshit. Therefore it is likely that other components are bullshit too. AND if you get good enough lawyers you can throw out as much of the contract as you like; it's pretty much a house of cards thing.

So, IF the owners choose to be dicks about it, they can choose to invalidate whatever parts of the CBA they want because clearly it's a flawed contract. If one of the basic tenets of the CBA isn't actually enforceable, then there MUST be a whole ****-ton of other stuff that isn't actually worth enforcing also, like rookie salary caps, vet minimums, standard increases of the salary cap etc. Ultimately, the owners have a golden opportunity to fire Goodell if they like and say FU to the NLFPA and write up a new CBA that better suits them.

Meanwhile, the players have a perfect opportunity while the gettin's good to put heat on the NFL to get some fine money back or at least put the screws to them for the completely random assignment of fines and suspensions that Goodell has subjected players to over the years.

Whatever, Pretty much played out the way I always thought it might. The main point I would like to make is this:
If anyone truly believes that an investigation, report, decision and an appeal all gets wrapped up exactly one week before the first game, that that could possibly be a coincidence. They are simply F'kn stupid. The NFL continues to feed us this bullshit like we are all morons to the greatest degree. This **** was all purposely dragged out on and on and comes to a conclusion 7 days before the game. C'mon. Born at night, but not last night.

Yup. Why do I have a feeling the NFL didn't fight this too hard? Did they question the two ball boys under oath? How come we never heard about it? Dog and pony show so the NFL can look like they are being tough on him.
 
Not surprised at all, about the ruling. Kr*ft will file very shortly and his fine / penalty may get over turned. The nfl will have to file an appeal or face the backlash of NO CBA agreement. As petty as this may sound, i do hope the refs / officials start treating t*mmy b*y like a regular joe fuckstick. The punishment of a beating (S) will change a lot of things about him. His age won't let him take the abuse for extended time, see yaz in the spring........ sort of thing.

I understand what you are saying, and he was definitely cut off at the knees for this type of unprecedented case. But the idea that Marijuana suspensions are going to be overturned or even challenged based upon the Brady ruling is false. The court simply said he was injudicious in this very limited unprecedented case. I would very much say that the Ben Roethlisberger case and the Harrison decision is very much on point to this. Harrison may bring it up because he hates Goodell. My guess is Ben just wants to move past and not bring that **** up.

Roethlisberger may have the strongest case. From what I understand, the basis of the ruling is that the CBA does not specify general knowledge of bad behavior as a punishable offense. Where in the CBA does it say that just being accused of a crime, even if you are never charged or prosecuted, is a punishable offense?

I would very much like to know the exact questions and answers of the two equipment guys. Pretty hard to imagine they didn't ask them the direct question "Did, Tom Brady know the footballs were being deflated" Can you please explain his knowledge in light of the texts. If they answer no and they lost their jobs anyway, I'd be inclined to believe them.
 
NFL will not seek stay of Brady's suspension

The Boston Globe's Ben Volin reported the NFL will not seek a stay of Judge Richard Berman's decision to nullify Tom Brady's four-game suspension.

This confirms an earlier report from NFL Network's Ian Rapoport. This means Brady will be able to play while the NFL appeals the ruling. With the appeal process likely to take several months, Brady should get in a full season regardless of the appeal decision.

And if you're a conspiracy guy like me... That's what we call an event of notice. The NFL quietly goes about it's business and pretends to be outraged.

Ya... Uh huh. Flood the league with emails demanding that they refund fine and suspension money for every player that Goodell punished or that he write detailed public defenses of why he doesn't do that. And don't stop. Copy your email and send it over and over and over.
