Supreme Court nominee Neil Gorsuch’s path to 60 votes is rapidly closing — setting the stage for a nuclear showdown in the Senate as soon as next week.

Senior Democratic sources are now increasingly confident that Gorsuch can’t clear a filibuster, saying his ceiling is likely mid- to upper-50s on the key procedural vote. That would mark the first successful filibuster of a Supreme Court nominee since Abe Fortas for chief justice in the 1960s.

If Democrats successfully filibuster Gorsuch, Majority Leader Mitch McConnell has heavily telegraphed that he will invoke the so-called nuclear option to unilaterally change Senate rules with a simple majority vote. And Republicans are confident they’ll have the votes to do it, even as wary as many senators are about forever altering the deliberative nature of the chamber.

“We’re not going to be treated by a double standard,” Senate Majority Whip John Cornyn (R-Texas) said in an interview on Monday. “We’ll give our Democratic colleagues a chance to see if they provide the 60 votes; if they do, it’s a moot point. And if they don’t, as I said before, we will confirm him one way or the other.”

Dems are really taking a ton of risk here. They better hope Ginsberg's health doesn't drop. They would lose the SCOTUS for the next 20 years with another conservative on the bench...probably a jurist more right than Gorsuch.

I think the Dems need to be pragmatic. They can not win here...why put up a fight that you are gunned to lose?

As for Ginsberg, she won't much longer. She's older with some illness. The life insurance experts would say she's 50/50 to make it past Trump's first term. If Trump is re-elected, I'd say the odds of her being replaced are at least 80% likely.

McConnell guarantees Gorsuch will be confirmed on April 7

Neil Gorsuch will be confirmed to the Supreme Court on April 7, Senate Majority Leader Mitch McConnell guaranteed on Tuesday.

“He’ll be on the floor of the Senate next week and confirmed on Friday,” McConnell told reporters. “We are optimistic that [Democrats] will not be successful in keeping this good man from joining the Supreme Court real soon.”

The Democrats must learn through pain, specifically the agony of watching Neil Gorsuch take the seat that they stompy-feet insist belongs to Merrick Garland. For too long, they’ve packed the bench with liberal partisans committed to exercising raw power as an end-run around democracy and the Constitution. Well, if raw power is the rule, then they need to choke on it. And we should laugh at their pain even as we amplify it via the Nuclear Option.

Oh Harry, your corruption and general unpleasantness make it so much sweeter knowing that you will only be remembered, if at all, for allowing Republicans to repopulate the Supreme Court with right-wing justices. Thanks to you, the liberals have squandered their best chance to fundamentally transform America from a constitutional republic into a huggy, libfascist dictatorship.

Oh yes, the Republicans must use the Nuclear Option. Nuke the site from orbit – it’s the only way to be sure that we have at least a couple decades before Chelsea, or whichever other quarter-wit dynastic Democrat cheats its way into the Oval Office, and can eliminate our First, Second, and probably Third Amendment rights. With Democrats, the only Constitutional rights that are safe are the ones that appear nowhere in the text, and it is open season on the ones that do. Except for the Fifth Amendment – Democrats love that one.

As recent as the 80's that would not have been the case....DC is all about strict political lines now. I'm not even calling it the "Nuclear Option". From this point on it should be identified at the Harry Reid Rule...make the Dems own and choke on it.

McCain says will support changing rules to confirm Gorsuch

U.S. Sen. John McCain on Monday announced that he will support an upcoming effort by his fellow Republicans to win Senate confirmation of Judge Neil Gorsuch to the Supreme Court by changing the chamber's rules in order to overcome Democratic opposition.

McCain, in remarks to reporters, said he had "no choice" but to go along with a change in rules ending a tradition of 60 votes in the 100-member Senate needed to advance Supreme Court nominees to a final vote. He said he would support the rule change "because we need to confirm Gorsuch."

In the past, McCain has strongly opposed such a change.
