The Coronavirus thread

More on the woman. She's no shining star, has her own troubled past. According to the woman that shot the video, she was not warned in advance of being arrested. She claimed she can't wear the mask due to asthma.

According to Tiffany Kennedy, the woman who shot the above video, Kitts had not been warned for not wearing a mask prior to the officer approaching her. Kennedy also said that Kitts has asthma and that’s why she was not wearing a mask.

“There is no reason to tase someone and arrest them for not wearing a mask,” Kennedy said.

Kennedy also pointed out the female officer who is shown running toward the Logan officer and Kitts at the end of the video was not wearing a mask – pulling one out of her pocket as she was in pursuit.

“Alecia’s mom said that when the officer tased her, the current went through the bleachers and zapped the kid sitting there too.”

Other articles have the police claiming they did in fact warn her in advance.

Who knows. One witness says not.

I don't think anywhere in the country mask wearing has been made a "law." They are mandates. Could a decent lawyer explain to me how I can be forced to wear a mask under a mandate that is not a law?

It seems they get around this like they did with this woman by pressing ancillary charges like trespassing. Can it legally be called "trespassing" if I'm at a public facility that hundreds of others are attending at the same time because I'm not wearing a mask? Trespassing usually involves entering property unlawfully. If mask wearing isn't a law, then how can it be considered trespass to enter without one when the public is permitted to attend?

Sure wish I new a decent lawyer......

the only one I know is old, decrepit and has far more advanced dementia than Joe Biden. we keep him around until we're out of oatmeal, then we'll put him out in some major city for some bleeding heart to take care of.

Most jurisdictions with such requirements have had the order implemented by a mayor with broad policing power for "the public interest" and based on a "health crisis." Amazingly enough - like a blind sow finding an acorn - you have unwittingly stumbled upon the truth when you say such orders are not laws, since laws are enacted only by the legislative branch. However, much like the Federal government, states have assigned their legislative powers to governmental agencies, such as the Dept. of Health. The mayor, for the most part, and on occasion a governor (such as Gavin "Smokey the Firestarter" Newsom in California) can issue an executive order, directing the Dept. of Health to issue an order under their authority that citizens wear a mask under certain conditions.

However, at least 1,000 lawsuits are now being litigated across the nation as to what powers, if any, the government has to punish citizens for refusing to accede to such orders. The lawsuits are well-founded, since the 4th and 8th amendments require that citizens be apprised of the punishment for violating a specific law or order, and that the punishment is well-defined for a very specific violation.

Clarity in Criminal Statutes: The Void-for-Vagueness Doctrine.

Criminal statutes that lack sufficient definiteness or specificity are commonly held “void for vagueness.”1086 Such legislation “may run afoul of the Due Process Clause because it fails to give adequate guidance to those who would be law-abiding, to advise defendants of the nature of the offense with which they are charged, or to guide courts in trying those who are accused.”1087 “Men of common intelligence cannot be required to guess at the meaning of [an] enactment.”1088 In other situations, a statute may be unconstitutionally vague because the statute is worded in a standardless way that invites arbitrary enforcement. In this vein, the Court has invalidated two kinds of laws as “void for vagueness”: (1) laws that define criminal offenses; and (2) laws that fix the permissible sentences for criminal offenses.1089 With respect to laws that define criminal offenses, the Court has required that a penal statute provide the definition of the offense with “sufficient definiteness that ordinary people can understand what conduct is prohibited and in a manner that does not encourage arbitrary and discriminatory enforcement.”

We have 10 positive cases at the HS- 8 are on the varsity football team. So all football and football related activities are indefinitely suspended. The kiddo in our class is NOT one of the cases- because of the language barrier and lack of parental involvement, he was ordered to quarantine out of safety- he won’t be back until after October 8. Fun times.

To me, it's no different than the school having a policy of no cussing on school grounds and some guy is next to the bleachers cussing like a sailor. He is going to be asked to leave. When that person refuses, the school is going to involve the law. Then, when the police come and ask you to leave and you refuse and resist being removed from the "stadium" you are asking for trouble. When you resist arrest, nothing good is going to come from it. Fight it in court.

Now, I personally disagree with the policy in the first place. As I have stated a number of times, I think as a nation we have been had over this covid stuff. Still, the school had a policy. Right, wrong, or indifferent, agree or disagree, the school can make this policy. And she knew the policy and violated it anyway. It sucks, but if she had put on a mask or got up and left when asked, she doesn't get tased or arrested. But she chose to fight and make a scene. So, she got tased. Boo-hoo. Stop acting like Karen.

I agree with this, however, the tasing was unnecessary and over the top in my opinion. I wear a mask when required. I dont like it and sometimes expose my nose for some fresh air.
 
So as many of you know, my son is a basketball player. Senior year in high school. While the state of Maryland has dictated in October that high school sports should resume, my Uber-Liberal county (Montgomery County, MD) decreed they are "following the science" and it's not safe enough yet. They are sticking with having all sports played in the spring.

My son is trying to get a college scholarship. As of now a dozen schools are looking at him. Several have said, "we'd like to come see you play in a high school game." By spring, their commits will be done. **** Montgomery County.

Anyway, we only have AAU basketball right now. That's his only option to get more tape and invite coaches. So since July, we have been to 8 weekend tournaments. Kids are playing.

Here's how it goes. We all show up...sometimes thousands...in masks. Then the kids go maskless. On the sidelines, 20 minutes before the game, joking around, hanging out. Then they play. Huffing and puffing on the court. Fighting for loose balls, rebounds, and sucking down each other's air. And potentially the COVID virus is being spread.

1,000 kids show up, from 1,000 different homes. We, the parents, all have to wear masks. The kids then play. Mix their germs. Then get into cars with their thousand parents and drive home.......

If it were spreading that rapidly, well.....

I'm telling you there are thousands of these big tournaments going on every weekend across the country.

As I told my wife, all of us in the stands wearing masks is meaningless. Those kids will be breathing and passing whatever is in their homes to and around each other. Then all of these kids get in cars and go home with the 'rents.

Can someone explain to me how spectators wearing masks at events like these helps, even remotely, given the above?

Most masks make my glasses fog up. The N95 is the worst. Trump 2020 mask fogs a little bit. My 2nd Amendment mask is the best in that regard. The Trump and 2A masks are just a piece of cloth with elastic behind my ears and don't protect from squat but hey, they keep the grocery store and Walmart happy.

this is just a dry run. They are establishing the precedent that if they gov claims a health emergency, then the constitution no longer applies. This is why liberals are so desperate to control healthcare.

Note also they scream about "separation of Church and State" yet have no problem with the State restricting or shutting down Church services.

We only have two grocery stores in town - wallyworld and City Market. Both require masks to get in. I usually don't wear one anyway. On those days that I actually have one, I wear it for the first 20 feet i to the stores only. Most locals don't either. The ones wearing them are employees or out of area folk.

All my masks are cloth. I have to make sure I have a mask that matches my outfit. That being said- our school district gave out 2 masks to each employee. Cloth. One was the kind that goes over your head with the 2 elastics. The other was a behind your ears one. Both had stickers in them that said “will not protect from airborne diseases.” But...since they show school unity and since masks are required, they “passed the mask test.” It makes NO sense.
 
I think I've made it pretty clear that I despise all of these unnecessary bullshit restrictions, especially the mask mandate. But, where it's required I comply. Disgustedly. Here's the one I wear:

Well....my whole class is under a mandatory 2 week quarantine starting today. Even though we all wore masks and all- the one kiddo in our room did test positive. So because of the contact tracing, the whole class has to stay home. I am PISSED. So for all those believers in masks working- **** all of you. I lose ANOTHER 2 weeks of my life stuck at home. So pardon me while I vent and say mean things. This is absolutely the most ****** up scenario and us perfectly healthy people pay the price. So **** the masks and **** the CDC.
