All my life, I thought gambling was NOT prohibited by the feds. I thought each individual state decided as to whether or not they wanted to allow it. Now that I know this wasn’t the case however, how in the hell were states like Nevada and Jersey able to get away with it all these years? Same thing with marijuana.... how can a state allow its citizens to possess and use it if the federal government says that doing so violates federal law? Doesn’t federal law trump a state law?

I believe that this has to do with sports gambling.

Okay... so how did Nevad and Jersey get away with allowing sports betting if the feds had laws on the books prohibiting it?

With the states, i think they have take the Obama era instructions that they are not allowed to enforce federal law (with regard to immigration) and use that with marijuana.

Jersey didn't which was the whole point of the SCOTUS case. Nevada was grandfathered in AKA bribes were made. There was no Sportsbook (legally) in NJ only NV.

We are living in a "no law too big to enforce" era. Enforcing a law is a choice, like an abortion. You can thank Democratic state governments for that.

My question really doesn’t have anything to do with enforcement of federal law. What I don’t understand is how a state is even able to write legislation... let alone pass and enforce, once it is passed.... that contradicts federal law thats been on the books for decades. I know what I’m about to say sounds ridiculous but it’s just to make a point.... obviously federal law prohibits kidnapping and murder, and I’m quite certain a state could never pass a law that allows kidnapping and murder. Now of course sports gambling is nowhere near as heinous a crime, but I always thought a law is a law is a law. Period.

You thought a federal law is an actual law in this day & age when illegal immigration laws get conveniently bypassed by "sanctuary" cities?

Funny how that sounds a lot like the discussion on Sanctuary laws.

Gambling and prostitution have been legal in Nevada since the late 1930's. I'm guessing the government's thought was to keep it all in one place.

We've had legalized NFL betting in Delaware for about 8-10 years now.

They call it a Sports "lottery" ...

No straight up single game betting, it has to be at least a 3-team Parlay or Teaser...

I enjoy it and play it every week during the season. Usually play a $20 - 3 team parlay that pays $130 on a winning ticket. I also throw in a 4-5 team teaser usually.
