Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Cory Booker: Americans should be 'thrown in jail' if they won't give up their guns
by John Gage
| May 06, 2019 01:31 PM

Cory Booker said he backs legislation that would get Americans “thrown in jail” for owning "assault weapons" if they do not hand them over in a buyback program in which they would be sold to the government.

Booker, a senator for New Jersey and 2020 presidential hopeful, said that incarceration would be an option after a “reasonable period" following the buyback offer.

“Again, we should have a law that bans these weapons, and we should have a reasonable period in which people can turn in these weapons. Right now we have a nation that allows in streets and communities like mine these weapons that should not exist,” Booker said on CNN on Monday.

Booker’s statement was in response to a question asked by CNN's Poppy Harlow about his gun control proposals. “Senator Booker, before you go, one final question on your gun proposal since you just released it this morning: Your competitor in the 2020 race, Congressman Eric Swalwell has also, like you, proposed an assault weapons ban,” Harlow said.

“He's proposing a buyback program where Americans who currently have those guns could sell them essentially to the government, but if they don't, within a certain period of time, they would be prosecuted ... thrown in jail, perhaps. Are you supportive of the same?”

Booker, 50, responded affirmatively that the law would be enforced with criminal sanctions after a “reasonable period." He had said earlier: "The critical thing is, I think most Americans agree, that these weapons of war should not be on our streets."

Earlier in the day, Booker unveiled a 14-part gun control plan, which included a ban on assault weapons including high capacity magazines.

“The biggest thing in the proposal is a national gun licensing program, which would force Americans to apply for 5-year gun licenses before obtaining a firearm. The process would include fingerprinting, an interview, gun safety courses, and a federal background check,” Booker said in a statement announcing the proposal.

He understands Amendment IV, he just classifies this as reasonable search and seizure.

And he is wrong.

Read the 2nd Amendment the language is not unclear in the slightest. Further this would guarantee another universal civil war.

You can't let liberals define what is a reasonable application of federal power.

clearly he does not.

did the government sell those arms to the people, or did the people purchase those from a business not related to the government? If the government sold weaponry to the people, then a buyback can be requested. If the people purchased from a private party, then a buyback would be to force people to sell their weapons back to the people/place they purchased from - assuming that those people/places are even interested in purchasing them.

if you force people to sell their weapons, then you're violating the 4th - as outlined above - since the government has zero need to know what a private individual owns. By encroaching on the 4th, you're simultaneously violating the 2nd. Which would make the 1st null and void.

So, no, Spartacus Booger knows not what he says.

Well then by Jesus, go into the streets of Chicago, Los Angeles, New York, and get them off the streets. Stop trying to force your ******* stupidity on law abiding citizens.

That makes too much sense for Spartacus.

Those cities should have strict gun control laws. And laws against murder, robbery and burglary. That **** would stop NOW.

Funny how the states with very liberal (in the classic sense) gun laws - Arizona, Texas, Florida, Alaska, Wisconsin, Idaho, Kentucky, North Dakota, Oklahoma, Utah - don't have the massive gun violence plaguing the deep blue cities.

The right to own and carry firearms is specifically delineated in the second amendment. How would you feel about restricting a constitutional right that is merely "suggested" in the constitution? Let me phrase it the way Booger would:

“The biggest thing in the proposal is a national abortion licensing program, which would force Americans to apply for 5-year abortion licenses before obtaining an abortion. The process would include fingerprinting, an interview, abortion safety courses, and a federal background check,” Booker said in a statement announcing the proposal.

So would you be all for the abortion safety program?? If it saves just one fetus ...

Without a doubt whatsoever on the war part. They had better come up with their own army loyal to them alone to even last a month.

This country needs a serious enema by constitutional convention. Got to pull the weeds, cull the hard and get these clowns out within 2 terms. No lifelong pension **** either. This **** has to happen to save the republic.

I'd bet there are a few more CONSTITUTIONAL provisions that he does not understand.

Get the lunatics off the streets. Leave the guns so the sane can protect themselves from the lunatics.

This guy wont get anywhere.....He is a bunch of hot air and seems like the public tunes him out according to his poll numbers. I think it will come down to Biden, Sanders, and Mayor Pete as the top 3. I think Sanders will pick Warren as VP (he always talks about her). Biden is only running on beating Trump which may be enough. I have barely heard any policy from him.
