Actually, it's not just Pats fans that think preponderance of evidence isn't proof of guilt. Anyone who understands the law when proof beyond a reasonable doubt isn't required knows this. In a civil case, you only have to believe that it's more probable than not (50.1%) that something occurred. The NFL didn't have to be certain that Brady / Pats were guilty. They only had to conclude that there was a 50.1% chance or better that it happened. FAR from proving guilt.

Uhh, idiot, proving that the Cheatriots cheated by 50.1% of the evidence is proving they cheated. Why the ******* hell do you think the league has to prove cheating or indeed any violation of league policy meriting punishment "beyond a reasonable doubt," i.e., the level of proof needed for a criminal conviction in the United States?

Preponderance of the evidence is sufficient for the OSHA to prove a civil violation that could yield substantial fines, or upon a showing of repeated violations (by a preponderance of the evidence), an order shutting down a business.

Further, you have literally no idea how clearly the league showed the cheating. You keep arguing that the cheating was proven by no more than a preponderance of the evidence. No, the cheating was in fact proven by a preponderance of the evidence - the applicable standard - but that certainly does NOT mean it was not proven by something more, such as clear and convincing evidence or beyond a reasonable doubt.

Every case that fails to meet the preponderance of the evidence standard fails to meet the higher beyond a reasonable doubt standard, but cases that meet the preponderance of the evidence standard do NOT thereby fail to meet the beyond a reasonable doubt standard. Every dog is a mammal, but not every mammal is a dog.

For at least the 3rd time now, evidence beyond a reasonable doubt was not required in Spy Gate. It was solely based on a preponderance of the evidence and they only had to be 50.1% sure that the violation occurred. They didn't have to be proven guilty and they never were.

By my count you’ve been asked a dozen times to answer the question. If there was no guilt, why was there fines and draft penalties? You are using a Op Ed to support your opinion. Understand research, you need fact based evidence to support your opinion. Biased opinions go both ways.

Your assertions are based on supposition that is convenient with the absence of the empirical evidence destroyed by Goodell. The evidence discussed that resulted in the fines and franchise penalties and included the taping of walkthroughs, sideline hand signals and the misappropriation of other teams materials. All from witness accounts from various former staff members and from your team owner’s production company.

Steeltime - have you ever been pretty sure of something? Not 100%, but pretty sure? Assuming you were pretty sure of something at least once in your life, does that mean that you proved it to be true?
