AB accused of Rape (update dipshit released by pats)

I am not questioning why the NFL would want to interview her. That is obvious. I am wondering why she would agree to do it. She is under no obligation to do so and it makes no sense that she would. I can see no gain for her and probably a few pitfalls for her case.

I doubt she says a word other than Hello. Her lawyers will be fielding all questions, and returning all responses.

They're going to assess her credibility and imagine her going on 60 minutes and describing what occurred juxtaposed with the disgusting emails and whatever else she has and decide if keeping him around is worse for them than letting him go.

Sure. But what is her motive for agreeing to the meeting. Spike provided the best answer so far if I understood him correctly...convince the NFL they have a problem so the NFL will pressure AB into a large settlement.

well, to be fair, we previously discussed that if any of us had been raped we would want the ****** to "pay" - be it in monetary, justice or public recognizance if not all three. We'd wondered why these women who claimed sexual assault or rape by a celebrity or NFL player was so quick to accept a pay out instead of doing everything they can to bring "awareness" of this.

as I said above, she's likely not going to say much to the NFL personally. Her lawyers will handle that. Why? to ensure that she does get a big pay day. To make her case more credible and her story more believable. The longer this goes on, the higher the pay out will be. But, is that justice? To me, I don't know. I'd say that had I ever been raped (yes, men can be raped) that I'd want the rapist to be incarcerated first and foremost. Then, if there were a way to extract any monetary settlement from this, I'd go after that.

But, I'm not going to admonish her for going the route her attorneys have decided to go. If she gets a ruling in civil court that says AB more likely than not did rape her - or at the least sexually assault her - then it may open venues for a criminal proceeding. The Florida DA is looking at this already. Keep in mind, she doesn't have to prove beyond the shadow of a doubt that he did rape her, just that he could have. Based on his texts, emails, the way he's conducted himself for the past few years... it wouldnt take much to get a panel of NFL wallets to believe this.

And, I'm not saying he did. As a human being, I hope he didnt.

AB was trying to get the Steelers to give him a new contract... his antics led them to finally put him on the trade block for real.... almost immediately Tom Brady contacted him, and the pats were offering a first for him, but the Steelers were going to trade him to buffalo... who would absolutely never have let him go to the pats even if they had to lose money doing so...
he manages to blow up that deal, and sink his value... the Steelers still won’t trade him to the Pats... they trade him to the raiders...

He then systematically starts trying to get cut from them... asking for a ridiculous new contract that they give him... all the tweets looking like a lunatic... the injuries and not practicing... the gm fight... everything... but Oakland never flinches about cutting him, so he gets this girl to file an obviously bs civil complaint knowing the Pats will still take him in and support him... but the Raiders snap and cut him right before week 1...

The wheels for this were already in motion...

The pats and AB are taking it lightly cause they know this girl is already a paid patsy who will recuse her story when pressed... ab is excused and the Pats come off looking good for standing by him...

I can totally believe that.

The police report on the bust states Edelman “reached under” a woman’s party costume and “grabbed her vagina” while they were on the dance floor.

Edelman was arrested by Boston police and booked soon after.

”The Patriots are aware of reports regarding Julian Edelman and will defer all comments to his representatives.”

Later, during a conference call with the media, Patriots coach Bill Belichick was asked if this might impact Edelman’s standing with the team. Belichick responded: ”I don’t think we have enough information to comment on that right now.”

You may have missed it in all the fake news and insane frenzied speculation in here but that amount is simply procedural to start a federal case

Requested damages of $75,000 is the statutory minimum for a federal district court to have jurisdiction in a civil matter.

It's not an arbitrary number; the attorneys almost certainly wrote "no less than $75,000 in money damages" specifically so a federal court would get jurisdiction (making it more high-profile) and so damages were theoretically unlimited.

I expect Goodell will suspend Brown for a few games and the Pats won’t fight it. As NBC showed during the game, the Pats first half schedule is cupcake. They don’t Need AB until the playoff push.

The benefit is to win the public perception and attack his character. This is the closest she will ever get to full retribution, since he won't do time for it, she can at least make it so he loses some of his sponsorships, and that will hurt AB more than anything.

That he isn’t already on the commissioner’s exemption list is a cryin’ shame.

If the Pats knew, they are even bigger scumbags, as if that’s even possible. Remember, Rosenhaus said he & AB were fully aware of and expecting this. The next question was whether or not the Pats also had prior knowledge and he refused to answer.

I dated a girl in high school, and there were photos of us being affectionate, kissing etc.

I'm pretty damn sure if I walked up to her and kissed her today she'd be really really pissed.

Yeah, it's true. She's meeting with them. Maybe our resident Counselor can explain why exactly that meeting is taking place.

No idea why she would meet with the NFL. I mean, she is free to do so, but if she says something stupid or contradicts her prior allegations, her statements are not precluded as hearsay (admission by a party opponent, Fed. Rules of Evidence, §801(d)(2)) and can be used to discredit her.

Possibly she set the meeting to pressure AB to settle the case. Would I have my client engage in such a meeting? No. Is she trying to leverage the situation for a little more $$? Seems like it.

Yes, she could. She cannot cite her own statements to the NFL in any later official proceeding (Fed. Rules of Evidence, §801(c)), while the other side (Brown's lawyers) can cite any information she provides - ANY - and seek to disprove or discredit the information.

That is how these cases are won and lost. Credibility is absolutely paramount. If the defense can show 2-3 times where the accuser changed her story, they accuse her of lying 2-3 times and can turn the case. For that reason, my client's don't offer "free" testimony that does no good and can in fact do harm.
 
Zero. They are a business, so they don't need proof or criminal conviction to punish or fire, like any other company really. I am certain she will be there with her legal council. That is how those corporate things work.

The NFL has been investigating criminal acts for decades. Anyone outside of employment doesn't have to cooperate, but if it helps their legal case, they will.

She has zero obligation to speak to NFL investigators. Zero. Their findings are completely irrelevant to her case and useless in terms of her lawsuit.

They can ask to speak to her, but she would be well-advised to tell them to send written questions which she answers with the help of her attorneys, and with no signature, verification, attestation, or acknowledgement by her that she is the one making the statements.

True in part. The $75,000 limit is for cases brought under something called diversity. No, not that type of "diversity." Claims between citizens of different states, such as this one, may be brought in Federal court if the damages are greater than the $75,000 jurisdictional limit. (28 U.S. Code § 1332.) Claims brought in Federal court for violation of Federal law involve the "Federal question doctrine" and have no jurisdictional limit. Therefore, a claim brought for violation of FMLA - Federal law, 29 CFR § 825 - does not have a jurisdictional limit.

Oh, and as a freebie for you freeloaders ... cases brought in Federal court under diversity are governed by substantive (as opposed to procedural) state law, in this instance where the wrongdoing occurred, under something called the "Erie doctrine" since there is no Federal common law (well, there's some, but that's a different story).
